Plaintiff filed a lawsuit alleging claims against defendants for violating the Consumer Fraud and Deceptive Business Practices Act, bad faith pursuant to Section 155 of the Illinois Insurance Code, declaratory judgment, and promissory estoppel. The trial court denied a motion to dismiss filed by defendant and certified a question to the appellate court asking whether underinsured motorist coverage is automatically required to be included in a policy insuring liability for bodily injury where the policy provides uninsured motorist coverage at the minimum limits required by the Illinois Vehicle Code. The appellate court answered the certified question in the negative and remanded for further proceedings.
